Military Law
Attorney Nancy J. Truax, after serving for over 26 years, retired from the U.S. Coast Guard at the rank of Lieutenant Commander (O-4) in November, 2007. Her personal experiences as both an enlisted member and an officer provide a unique perspective on military law and military justice issues. She is experienced in dealing with commands, staff judge advocates and prosecutors, but is also sensitive to the issues and pressures facing junior enlisted people, having been one herself.
As the Senior Appellate Defense Counsel for the Coast Guard, Ms. Truax represented hundreds of clients in the appeals of their court-martial convictions, often resulting in the findings or sentence being set aside. As trial defense counsel, Ms. Truax represented scores of Coast Guard and Navy clients in general and special courts-martial and various administrative processes, frequently obtaining favorable results, including acquittal, dismissal of charges, disposing of charges in a lower proceeding, and negotiating plea agreements with favorable terms.
Because of her appellate experience, she can recognize and avoid the issues and pitfalls that many attorneys and even some judges may fail to recognize, and knows what to do to at the trial level to adequately “preserve” an issue for appellate review.
